New Employment Laws in 2011
With the beginning of a New Year, employers and employment lawyers have the duty to keep themselves updated of laws set to be put into effect in 2011. What’s more, employers need to be informed that their 2010 California and federal notices posters have just become obsolete and some employers may have the obligation to include extra postings.
In particular, all employers need to know that there are new 2011 editions of the mandatory federal posters such as “Federal Minimum Wage,” “Equal Employment Opportunity is the Law,” “Safety and Health Protection on the Job,” etc. Furthermore, there are now 2011 editions of California required posters like “California Minimum Wage,” “Your Rights Under USERRA,” and “Notice Employee Polygraph Protection Act” posters, just to name a few. Every employer should display these at every work site in a place that can be accessed by all workers and job applicants. Employers may be obligated to display other postings too. In addition, some employers shall also be obligated to display other posters as follows:
Workers’ Compensation: The posting and notice requirements were revised in 2010 to make it mandatory for all employers using Managed Professional Networks (MPNs) to provide treatment for workers’ compensation claims to inform employees about regarding the Networks being used. Thus, in addition to the compulsory workers’ compensation poster (“Notice to Employees – Injuries Caused by Work”), Employers also have to display additional information about any MPNs they are using. Lastly, any brochure handed out by the employer pertaining to workers’ compensation also has to include information on any MPNs the employers are using.
San Francisco: The San Francisco minimum wage increased as of January 1, 2011 to 9.92 dollars hourly. Employers have the duty to display a poster informing their workers of this change in English, Spanish, Mandarin, and any other language understood by at least 5% of the personnel. A notice regarding the minimum wage bearing the employer’s name, address, and contact number also has to be given to every employee upon hiring.
